TERMS AND CONDITIONS
Please read carefully the Retreat Agreement (the “Agreement”) within this you agree to be bound by the Agreement between The Beautiful Dance (the “Company”) and you.
Reservation & Payment
To reserve your place on the retreat please complete the reservation on BookRetreats.com and submit it together with the non-refundable deposit for the retreat. Deposit payments must be made through the Bookretreats booking platform (Bookretreats.com). There is in place a 72 hour grace period in which you may cancel your booking and will receive !00% refund of your deposit. Final balances are due at least thirty (30) days before the retreat start date and made directly to the Company. For reservations made within 30 days of the retreat start date, full payment is required when the reservation is accepted. If payment of the balance of the retreat price is not received by the Company by the required date, we will assume you will not be participating in the retreat and cancellation charges in accordance with Section 6 may apply.
Your Obligations as a Retreat Participant
Follow considerate social behaviour with other trip participants and respect their habits. Act in an appropriate and respectful manner befitting the customs of places you visit. Respect the places we visit by staying on established routes of travel, not littering, and doing your best to “leave no trace”.
Health and Fitness Requirements
You must be in good physical and mental health to participate in the retreat. If you have any medical or psychological conditions, it is important you let us know well before departure so we can make extra arrangements if necessary. The retreat is not intended for medical or clinical therapeutic purposes. The Company is not a medical facility and therefore has no responsibility regarding medical advice or medications that you or your doctor deem necessary for your safe participation. You are strongly encouraged to consult with a physician to ensure that you are in adequate health to safely participate in the retreat.
Our retreats may take place in remote areas where there is little or no access to normal medical services or hospital facilities for serious problems. Medical expenses will be your responsibility. The Company strongly encourages and recommends purchase travel insurance with a comprehensive medical policy.
Additionally, the Company retreat leaders reserve the right at any time to refuse a participant the right to participate in the retreat if retreat leaders feel you are mentally or physically incapable to attend or continue and/or if a trip member's continued participation jeopardizes the groups or their own safety. Under these circumstances, refunds are not given.
Insurance
It is your responsibility to make sure that you are adequately insured for the full duration of the retreat in respect to illness, injury, death, loss of personal items, cancellation, and curtailment.
Refunds
The Beautiful Company does not give any refunds for unused hotel rooms, meals, trips. Retreat price is quoted as a package; credits are not given for services not used.
Cancellations by Participant
If your retreat is scheduled to operate, but you have chosen not to attend the retreat for any reason, you must notify the Company in writing and the following policy will apply: All deposits are non-refundable/non-transferable. Fifty (50) percent of the balance must be paid sixty (60) days before retreat start date. Total remaining balance must be paid thirty (30) days before retreat start date.
If you decide to cancel your trip, the following fees apply and are due at the time (prior to departure) we receive written notice of your cancellation.
More than 60 days before the retreat start date, receive a full refund of your payment, excluding your deposit. 31 to 59 days before retreat start date, 50 percent of any payment previously made may be applied to another retreat, excluding your deposit. You will forfeit 50 percent of the price of your retreat, excluding the deposit. If you cancel 30 days or less before the retreat start date, you will forfeit your entire payment.
Cancellation Due to Retreat Booking Numbers
The Company reserves the right to cancel any retreat prior to departure in the event that there are too few people booked, in which case you will be given a full refund of any and all payments, including your deposit.
Changes, Postponement, Cancellation or Delay by Company.
The Company reserves the right to make reasonable changes in the itinerary where deemed advisable for the well-being of participants. Company reserves the right to make changes to any aspect of the retreat if, in the absolute and sole discretion of Company, it is necessary due to conditions that may be hazardous or dangerous or due to any other adverse or threatening conditions such as pandemics, weather, political, military, terrorist or otherwise or any other reason considered necessary by Company. Company also reserves, in its absolute and sole discretion, the right to cancel any retreat due to any material change in any government travel warning or advisory. If the designated trip leader is unable to lead the trip for any reason, Company, in its absolute and sole discretion, will enlist another trip leader of substantially similar qualifications to lead the retreat.
In the event of the Company cancelling the retreat you will receive a full refund.
In the event that a retreat must be postponed, 100 percent of all payments made for the previous booking will be applied toward the same retreat on future dates, less any non-refundable, non-transferable fees including but not limited to airlines, train, bus, entrance tickets or permits purchased by Company on your behalf.
Photography
The Company reserves the right to use photographs or videos from the retreat for promotional purposes. By making a reservation with the Company, you agree to allow your image to be used in such photography. If you prefer that your image not be used, please notify the Company in writing before the retreat commences and we will not use your image.
Force Majeure
If the Company and retreat leaders are prevented from performing any of their obligations under this Agreement by acts of God, strikes, trade disputes, fire, weather, breakdowns, interruption of transport, government or political action, acts of war or terrorism, acts or omissions of a third party or for any other cause whatsoever outside the Company and retreat leader's reasonable control, the Company and retreat leader will be under no liability whatsoever to you and may either cancel or postpone the retreat.
Assumption of Risk.
You acknowledge that travel involves potential exposure to dangers and hazards, including equipment failures and negligence, and as a consequence of these risks, you may be seriously hurt or disabled or may die from the resulting injuries, and that your property may also be damaged. In the locations in which many of our retreats are held, standards of accommodation, transport, hospital facilities, qualified health care, hygiene, safety, and service may be limited and may require flexibility and patience on your part. The Company assumes no responsibility for providing medical care during the retreat. You assume full responsibility for any costs related to medical care and/or evacuation that you incur. You further acknowledge that the Company may contract with independent contractors to provide any and all travel related services and that the Company assumes no responsibility, however caused, for injury, loss or damage to person or property in connection with any service provided by an independent contractor or resulting directly from the following: - acts of God - detention - annoyance - terrorism - thefts - pilferage - force majeure - civil disturbances - government restrictions or regulations - strikes - delays and expenses arising from quarantine - failure of any means of conveyance to arrive or depart as scheduled - discrepancies or change in transit or hotel services over which we have no control.
